In this case, Kellogg Co. v. National Biscuit Co., the Supreme Court ruled that Kellogg was not violating any laws (trademark or unfair competition laws) in the company’s creation of their own “Shredded Wheat” breakfast cereal. Kellogg essentially made another version of a product National Biscuit had made, but the patent for the cereal had expired. The Court also ruled that “Shredded Wheat” was a non-trademarkable term and simply only a descriptor.
