Infringement Case: Samsung Electronics Co. v. Apple Inc. / Jorell Jimenez

Apple sued Samsung on the basis that certain design elements for Samsung’s smartphones infringement on certain patents that Apple held for design elements in iPhones. The jury decided that Samsung did indeed infringement on the patents and awarded Apple over one billion dollars in damages, but the district court issued a retrial as some of the damages were based on a period of time where Samsung did not have any notice of some of the patents. After retrial Apple was awarded around three hundred million dollars in damages. Samsung appealed on the basis that the award was based on their entire profits instead of profits that were directly attributing to the infringed patents, but the appeal was denied as the Court of Appeals stated that Samsung did not argue that there was a lack of substantial evidence to support the award.
